While nearly half of all U.S. states have joined in opposition to New York’s law already, the top plaintiff in the case expects more states to join. “While the ban only applies to New York at this time, the federal court’s upholding of the gun ban sets a concerning precedent interpreting limitations on Second Amendment rights of all law-abiding citizens including here in South Dakota,” South Dakota Attorney General Marty J. Jackley said in a statement. “An outright ban on semi-automatic weapons used for self-defense and hunting purposes violates the Second Amendment.” Edit: P.S. IMHO, it's becoming dangerously common for people who support the Second Amendment to rest their case on "self-defense and hunting" activities. A claim the S. Dakota AG repeats. While those are fine uses for firearms, the 2d Am is about a civilian militia -- which is grounded fundamentally in the notion of armed insurrection against government tyranny. It's a veto power vested in the fourth branch of government -- the people. Protecting your garden from rabbits by putting them in the stew-pot is not in the Constitution, though it certainly is an extra benefit.
