If it's the same article I was reading it states a exemption for Handgun armor piercing..

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has received requests to exempt certain projectiles from regulation as “armor piercing ammunition” under 18 U.S.C. 921(a)(17)(B)(ii) of the Gun Control Act of 1968. In this regard, ATF is seeking public comments on specific projectiles or projectile cores which may be used in a handgun and which are constructed entirely from one or a combination of tungsten, alloys, steel, iron, brass, bronze, beryllium copper or depleted uranium, and whether these projectiles or projectile cores pose a threat to public safety and law enforcement, or are, “primarily intended to be used for sporting purposes” and therefore may be exempted from classification as “armor piercing ammunition.”

All interested persons may submit comments to APAComments@atf.gov by December 31, 2012. Comments not received by or before December 31, 2012 will not be considered. All comments must include your name and mailing address. Comments are subject to the Freedom of Information Act.

I contend that nearly any may be used in a handgun, as BATF has been known to use a T/C Encore in pistol-mode.  "Alloy" is a HUGE little word, that is defined as such:

noun |ˈaˌloi|

a metal made by combining two or more metallic elements, esp. to give greater strength or resistance to corrosion: an alloy of nickel, bronze, and zinc | flat pieces of alloy | [ as modifier ] : alloy wheels.

• an inferior metal mixed with a precious one.

Scroll down to page 2 and we can see where this was amended by Ronnie Reagan, when he signed the FOPA in 1986.  It also says in the last paragraph “which the Attorney General finds is primarily intended to be used for sporting purposes.” 

I don't trust the current AG.

Page 3 "However, in developing a narrow sporting purposes test, ammunition in traditional hunting calibers will become regulated. Because of the proliferation of new, larger handgun calibers ATF must review the current sporting purposes test for armor piercing ammunition."

bullpoopy.  Just look at who is in charge.

Notice also that suggestion submissions MUST be in Word or PDF format, and no larger than 10MB in size.

Keep in mind this is the BATFE, they have said before that just because a rifle is used in a sporting event, does not make the rifle have a 'sporting purpose."  They have screwed us in the past, and will do it again, they are “Always Thinking Forfeiture” its their damn un-official moto.

Keep in mind that the BATF is always on the hook to get absorbed by another DOJ agency.  Rumors abound every fiscal year, which is why they guard NFA violations like a starved pit bull. Like most rumors they have been just that.....at least since the late 1990s.  Great people work there, and many are gun nuts like most of us, but from a corporate standpoint I'm not a fan.
