That non-compete that they had the fired employees sign is gonna be hard for them to enforce. Almost impossible.  Good luck DD, in trying to enforce that one.

Considering theres no severance package to leverage the non-compete with. If they are downsizing they sure cant afford to take everyone to court. Id do it out of spite.
