Bad Deal Thread *Update, BCG found!*

I've had an unfortunate business transaction with a member here, an item I bought thru the classifieds.  I have discussed this with one of the administrators starting over a week ago, and was told if it wasn't resolved by today to give an account on the open forum.  This is not enjoyable to me in any way, I simply want the issue resolved in a fair manner.  If this is in the wrong forum, feel free to move it.  Here goes.

You may remember a stainless bcg posted for sale by 308Gunner in early November.  I claimed it, and thru messages we agreed upon a usps MO, with $15 added for ups shipping.  I mailed the MO promptly within a day or 2 at the most, and it was received Nov 8th.  Brandon mailed the bcg out on the 13th or 14th.  By the 18th or 19th I was getting concerned, and got the tracking # from him.  It showed that it arrived in Rochester NY on the 14th and that is as far as it went.  We texted back and forth a few times, he was trying to figure out what went wrong and to get the insurance claim started.

I kind of chalked it up to one of those things, and figured the package would show up sooner or later, until the empty package showed up about 10 days ago.  It was a simple lined paper envelope from the ups store, with a hole in it.  And a note from the usps stated "We sincerely regret" bla bla bla.  Well I was a little perturbed that anyone would put a large chunk of iron in an envelope and try to mail it.  If it had been in a box of any kind I'd have it and none of this would have happened.

Ok so it happened, I just want my funds returned.  Brandon got defensive at  that point and said he's trying to do everything he can, and that it isn't his fault the mail lost it.  I say it definately isn't my fault either, but I'm the only one who's out $265.

Now I haven't heard from him since last Friday, his last text said his wife went into labor and he was a little preoccupied.  I can understand that and wish them all the best, and hope all is well.  That can be a stressful time.  But a quick text wouldn't take long, let me know what you plan to do, I let him know I just want the money back, and any insurance that's supposedly on it would be his to keep.  Throughout all of this I feel I have been civil and forthright.  I know if the situation was reversed I would take responsibility for not packaging a valuable (not to mention rare) item appropriately.  Three texts this past week have gone unanswered, including a simple one asking if everything was alright.

I really hope all is well with Brandon's young family, if anyone knows him personally please post anything you know of whether they're ok.

Thanks

Russ LeMunyan

Well, I barely believe this myself, but my phone rang 10 minutes ago, and it was a gal from the "loose items" department of the Omaha post office.  She described the bcg that Brandon sent me, and is packaging it up and sending it my way!  So this story has a happy ending and no one gets screwed.

I think I learned a lesson to have a little more patience.  Hopefully Brandon will accept my good wishes and apology for any stress he may have suffered over this.

First I would like to say that I am glad the item was found and is on its way to where it is supposed to be. Unfortunately I'm in a position that I have to try to clear my good name and will obviously never be able to sell anything on this forum again due to the created thread bashing me. First I would like to say the only thing I did wrong was have the shipping company package the item for me. After I learned the item was MIA I immediately contacted USPS to get the ball rolling on recovering the item or getting the insurance money to cover the lost BCG. The local USPS facility was kind enough to drop off the paperwork to following day to me. I filled out the paper work and sent it in to them. Unfortunately when I shipped the package and payed for insurance (Out of my own pocket) the facility did not annotate it in the system. Luckily I saved the shipping paperwork but made the claim more difficult. I spent Hours on the phone with different sort facilities/USPS/Claims Centers and took a total of 4 hours off work leaving early to drop off paperwork to the local post office trying to get this sorted out. Then the Empty package showed up and I had to completely start the whole claims process over because it was officially no longer a lost package, but a lost item. There was no great way to resolve the situation where neither of us got screwed out of either the item or the money. When he tried to get ahold of me those few days I had a family medical emergency in which I had to spend over a week 4 hours from my house. $265 or a BCG were the least of my concerns with my wife in the ICU and my new born Child in the NICU and a 3 year old with no family around. I really could not have done more to try and help out. It really is unfortunate that my name is now soiled on this site because USPS mishandled the product. There was truly nothing more I could have done to help Russ.

Gunner, you're fine, man.  It happens, and there were multiple complications along the way.  Communication is paramount in a transaction such as this, and you were in a spot where you had to make some priority decisions - and I think you made the right ones, with all things considered.

I'd buy from you in a heartbeat, and I don't think you're in a bad place here, on this board.  In fact, if you're selling more stuff, let me know.  I'll hop in and buy something from you.  If something happens, and I have to wait, what you've shown is that you'll do what you need to in order to make it right, and that you do have your priorities in order.  That says more than anything else.  <thumbsup>

Don't hesitate to list more things for sale, brother.  Don't think you're shunned, tarnished, or banished - you are very welcome here.

Tom

All is well that ends well. Russ got his item and you met your obligations as the seller. Feel free to continue posting items you want to sell, I think it's completely clear that the shipping service is the only one due any blame here.

In the future all buyers and sellers need to remember that transactions are strictly between the buyer and seller, and must be resolved between those two parties. If you want to post negative feedback on a transaction, please ask the Admins/Mods first.

Thanks, good luck with your buying and selling.
