Water boundaries can be very tricky. There are many, many court cases surrounding these and every one is different. In the end, hopefully you will see the state vs the fed and not leave the land owners carrying the court fees. Accretion, reliction, avulsion are all in play. Now, aerial photos can show the change over time. Typically a sudden change will not move the property line while slow movements will. However, if the slow movements can be traced to human interaction, like the building of a dyke or structure that redirects the flow of water or deposits of land...the line doesn't change. We had a big case about that here where a break wall had been built out into the ocean and in result the beach grew down current...it that case the state owns the land. These cases do get messy, and how do you determine "slow" change? It can't be specifically defined. Is it one inch a year? Six inches a year? That will ultimately be for a court to decide. My guess, Texas will win this one. Don't lump this in with the rest of what's going on around town...but I can't wait to hear the conspiracy spin to this one. You don't seem to get it: "the Court" in these cases is Federal, making the rules and laws for the BLM, and We the People are done with their property mismanagement and poisoning the resources. The jig is up, game's over, scumbags exposed to the bright sunlight, freedom and democracy will come back to these lands by use of force it looks like. The "Merchants of Doubt" are done. All I stated is these get tricky and it will end in court. I'd like to maintain the belief that some of the courts will do their job and not roll over for the man. I also said this should and will be a Texas vs Fed issue and shouldn't be shouldered by property owners. The tin foil hats I'm waiting for are how this land is also "being grabbed" to give away to a large corporation who is here only to enslave the people! Back to the serious side though, the Texas AG will plenty to talk about. Texas is one of the 20 states that was surveyed by a different fashion than the others. Don't take that to mean I'm siding with BLM...what I'm saying is the survey of Texas and the survey of the surrounding states are on completely different systems and have different definitions regarding water boundaries. Most are spewing the same info and I question the origin of the 90000 acres. They mention the 116 mile river and land along it. If they are looking at the erosion/avulsion of the river like they are said to have used in the 1986 case...and if it's only along that 116 mile stretch, the strip of land would be 6400 feet wide for the full 116 miles in order to make 90000 acres. That's over a mile wide. Something doesn't add up. Now before you take that to mean I don't believe the story, stop. All I'm looking for is better documentation of where the numbers are coming from. Those numbers are so crazy, there's no way in hell they could ever win that battle. 900, maybe 9000 along the river...I could see possible. The hard part about natural boundaries is their ability to change. There is no perfect system to fixing a boundary when it is bound by a moving line. Like I mentioned before, if the movement is caused by a human act, the line will stay "fixed" at that point from then on. The idea of slow is supposed to be "slow and imperceptible". I find it hard to believe that the whole river has only moved one direction. This all smells like some sort of distraction again. Get us all fired up watching the BLM stories.
