As a few of you know Monday my friend Debbie died, widowing my friend Ed.

 

Looks like this is going to be a major clusterphuck, with most everything in Debbie's name only.  That means a long, drawn out probate for estate in AZ, a community property state.

 

No will, no agreement for living on a relative's property, no agreement for payment for improving said property, and on and on.

 

Like Dave says "It is a FACT 100% of humans die...you need a will."  You also need Power of Attorney, instructions for what you want done after you die.

 

Debbie was not under a doctor's care, this is a total blindside...one day she's here, the next she isn't.

 

Could be you, or me, or a spouse/parent/child...to die or be left behind.

 

Get the appropriate paperwork done!

Have had a will since I was 19 and reviewed/updated it as needed...usually just before deployment. Also have a living will with clear instructions: vegetable = pull the plug!

I agree: make sure you have the proper paperwork in order because you never know when it's your turn!

Feel for your friend that's gotta be horrible. Just the fact he lost his wife then her family has to be like that?!?

when my cousin passed my dad had me set up a life insurance policy, yet to have a will I should really do that but I've got no brothers or sisters to get greedy over my poop

Sorry to hear about your friends.  Wills are a minimum, trusts are better.  Trusts don't have to go through probate, wills do.  Estate planning is a must.  Another good idea is a joint banking account with a trusted relative (son or daughter).  Once the bank hears a person has passed, they freeze all of the bank accounts.  With a joint account, your relative has access to cash to cover expenses.

It is a good idea to have a life insurance policy, they don't have to be probated and come in handy for your main heir to take care of final expense s and to retain a lawyer to probate a will. My wife is having to probate her single brother's will in Colorado and is his beneficiary to his life insurance and she used it to pay funeral expenses, probate the will, sell his house and two cars and has already spent over $12,000, and isn't finished yet. Nothing else except the life insurance, goes to her until the probate is completed.

Sorry to hear about you'r friend brother,tommorrow is promised to no one.Got my paper's in order and someone to help dispose of my arms so the wife get's a fair price.I'm ready for the last ride,just hope I'm not next in line.You just never know. <dontknow>

You are right...the other day a woman in a big black BMW rolled right into the intersection in front of me, didn't even tap the brakes.  T-boned the dude in front of me.  Nobody died but it happens fast.

when my grandmother died I started hearing about all the fighting between her children. (not my dad, he's been blacklisted and excommunicated lol) seems even with paperwork greedy family members still have an opportunity to fight for what they feel they are owed. a lawyer called me one day and told me I was named in the will and had a say in the proceedings. I told him to never contact me again. about a year later I got a $3000 check in the mail.
