You are ok. Lots of tubes have that cutout. Keeps the tube from spinning. Looks like they didn't tighten it enough during assembly. Do you have an armorers wrench? Back off the castle nut, hold the pin down, and turn the tube in one more rotation and you should be good to go. Or...just send it back and let them fix it if you don't want to buy a new pin.

Any chance you can snap a pic? Are you saying the end of the buffer tube actually broke where it holds the pin in?

What handguard is it? I ran into a similar issue with my PRI delta handguard. It seems they have rifle length that is suppose to be used with a low pro gas block, and then a special rifle length that is 1/4" shorter for use with flip up gas block sights or FSBs.
