ATF hasn't won that fight yet. They just won the fight (by passing it through a New York State District Attorney) that Rare Breed can't sell them anymore. Judge Reed O'Connor applied the Cargill decision to this case and threw out the case. He further ordered the ATF to return all seized and voluntarily surrendered property to their lawful owners.
