Of the 3, one had a knife and another one had brass knuckles.  They got the getaway driver - well, actually, a few hours afterwards, she turned herself in. She's 21. One burglar was 16, one was 18. 

Solid defensive work. :thumbup:

Continuing saga - those three a$swipes already hit that house earlier in that morning - detached garage.  Then they went back to hit the main house, and got smoke-checked. Names and ages released now.

I believe the DA intends to file Felony Murder charges against her.

In Oklahoma, if someone is killed during the commission of a felony -- even a co-conspirator killed by a property owner -- all surviving co-conspirators can be found guilty of murder. Essentially, the law looks at it this way: Had they not committed the felony of burglary, no one would be dead. Therefore, any loss of life that occurred during or as a result of the commission of the felony is the fault of those who committed the underlying crime.

Finally got to read that one. Pretty disappointed in that. The lone that got me was "the son opens fire on the intruders after an exchange of words"...or something similar to that. Almost makes it sound like he fired without threat. I hope the exchange of words was along the lines of "freeze motherfcuker!  Drop the weapon"

 Well they shouldn't of taken a Knife to a gun fight !

  On another note , what would they have said if they had killed the home owner , with a Knife & Brass Knuckles  & got caught ? They were just trying to get $$ for collage , they were good kids ! 

    They didn't deserve to die ? Well maybe they should have thought about that before they planed to assault anyone who was home at the time . You think they had the knife & Brass knuckles for jewelry , they had them for intimidation in case someone was home !

    There was a reason why they picked that house , they knew something was there & were going to get it one way or the other . It wasn't picked out random , they will not say what they were looking for in the news , as to not give other dead beats a reason to come back , with more fire power .

 These idiots made their choice & knew the potential consequences !

I'm sure grandpa has a single-shot 12 gauge hid in his closet for home defense. Would he really ask the burglars what they have in their hands before pulling the trigger?

Regardless... 21 O.S. §733:

A. Homicide is also justifiable when committed by any person in any of the following cases:

1. When resisting any attempt to murder such person, or to commit any felony upon him, or upon or in any dwelling house in which such person is;

2. When committed in the lawful defense of such person or of another, when the person using force reasonably believes such force is necessary to prevent death or great bodily harm to himself or herself or another or to terminate or prevent the commission of a forcible felony; or

3. When necessarily committed in attempting, by lawful ways and means, to apprehend any person for any felony committed; or in lawfully suppressing any riot; or in lawfully keeping and preserving the peace.

B. As used in this section, "forcible felony" means any felony which involves the use or threat of physical force or violence against any person.

733(A)(1) and (A)(2) apply here.

The threat of physical force of violence was present here. Possession of brass knuckles could be spun in such a way as to be used as a tool for breaking glass, but in Oklahoma they are still considered a dangerous weapon which is illegal to carry. The knife is unquestionably a dangerous/deadly weapon. Possessing these items during the commission of a burglary will strongly suggest to a jury that they intended to threaten and/or commit physical violence upon any person they discovered inside that home.

I love how the families of the wrong doers always claim some sort of justification for their actions or that they should be given some recompense for their loss. Nevermind that the dirtbags were stealing poop!!! Just waiting for that to come forth.
